The Decorster Portal service is an online platform enabling users to seek interior design services, let our expert interior designers guide you in making smart choices for their home and or premises. The aim of this service is to give users the opportunity to:

a) Design their respective homes by choosing their preferred design package.

b) Assist them with execution by giving them the option of selecting our custom package wherein, you receive custom quotes depending on the services that you select.

c) Shop from your favorite home décor and furniture brands at a click of a button.

2. GENERAL SCOPE OF SERVICES

"DECORSTER PORTAL” maintains the www.decorster.com Website ("www.decorster.com")

Here you can find all the terms and conditions that we apply in order to perform our provided services at the highest level of our standards. If you’re here, that means you’re smart enough to read them carefully before using our services as these terms of service (the “Agreement”) is binding between you and Decorster.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT APPLY TO YOUR USE OF THIS WEBSITE AND ANY MOBILE APPLICATIONS USED TO ACCESS THIS WEBSITE.

If you are a minor/under the age of 18, you shall not register as a User of the Application/Website and shall not transact on or use them.

If you are unwilling to be bound by this Agreement, please do not access or use the Application and/or Website (both defined below). Decorster Portal may terminate, without notice, your access to the Application and/or Website for failure to comply with this Agreement. In addition, Decorster shall be entitled, at its sole discretion, to suspend, restrict and/or terminate, without notice of any kind, your access to the Application or the Website or your Decorster account for any reason.

We will not trade with or provide any services to OFAC (Office of Foreign Assets Control) and sanctioned countries in accordance with the law of UAE.

By signing up to our website, checking any acceptance boxes, clicking any acceptance buttons, submitting any text or content or simply by making any use of the Application and/or the Website, you: (a) accept this Agreement and agree to be bound by each of its terms, and (b) represent and warrant to Decorster that: (i) you are of legal age and have the authority to enter into this Agreement, (ii) this Agreement is binding and enforceable against you, (iii) to the extent an individual is accepting this Agreement on behalf of an entity, such individual has the right and authority to agree to all of the terms set forth herein on behalf of such entity, and (iv) you have read and understand Decorster Portal's Privacy Policy, the terms of which are posted at the Website and incorporated herein by reference (the "Privacy Policy"), and agree to abide by the Privacy Policy. 

3. PROCESS OF REGISTRATION

To utilize the service and the features made available through the Application and Website, you may be required to sign up / log in to our website by establishing an account with Decorster Portal (“Account”), however you can always take our style quiz without creating an account with us. In order to register, it is necessary to provide personal data, which includes but is not limited to, your name, contact information (Email), and more. You represent and warrant that all information provided by you to Decorster Portal is current, accurate, and complete, and that you will maintain the accuracy and completeness of this information on a prompt, timely basis. The account created by you has to be verified by clicking on the verification email that you will receive once you sign up.

Should you suspect that any unauthorized party might be using your Account, you are obligated for your own security to notify Decorster Portal immediately by emailing us at hello@decroster.com. By providing your mobile phone number and email address to Decorster Portal pursuant to the use of the service, you hereby affirmatively consent to our use of your mobile phone number and email for contacting you directly in order to perform the services, including but not limited to occasionally send notifications, text messages with promotional offers, service updates and reach out to you to survey regarding the quality of our services. 4. LICENSE

Decorster Portal hereby grants you a non-transferable, non-exclusive, revocable, limited license to access and use Decorster Portal's software platform as made available through its website located at www.decorster.com (the "Website") and/or via mobile application (Application) during the currency of this Agreement, solely for the purpose of accessing the services. Decorster Portal may, from time to time, update or modify the Website and/or the Application, release new versions of the Application or create new modules related thereto, each of which may, Decorster Portal's discretion, be included within the license described above. You shall not be permitted to sublicense or transfer any of your rights hereunder including, without limitation, access to the Application.

Except as expressly permitted under other provisions of this Agreement, you may not modify, reproduce, duplicate, copy, photocopy, print, republish, display, translate, transmit, distribute, sell, resell, reverse-engineer, rent, lease, loan, exploit, reduce to any electronic medium or machine-readable form, or otherwise make available in any form or by any means all or any portion of the Website or the Application, any content, photographs, descriptions, drawings, audio materials, text, messages or other information or any data compiled or extracted therefrom or any information or materials retrieved from either of them, including, without limitation, graphics and logos, presentation, style or organization, in whole or in part, for any purpose.

However, you are permitted to print and download extracts or documents from this website for your personal use only without modifying its original content, related graphics and allowing copyrights notices to be appeared in all of its copies.

You shall use the Application and the Website solely for their intended purposes and shall not use the Application or the Website for the benefit of any third party except as specifically contemplated under this Agreement.

5. DISCLAIMER

The Decorster Portal service is an online platform forgetting interior design / décor solutions, with an integrated shop of your favorite furniture and home décor brands. Currently, the Decoster services are available only in UAE. The Decorster Portal service is not the provider, originator or the producer of the service nor is Decorster Portal liable for the quality, accuracy, reliability, relevancy or currency of the service. Decorster Portal merely sources the data from various third parties and makes it available on as is basis to the users in a customized format to enable the users to make informed decisions.

You understand that Decorster Portal does not and cannot review all the data and content made available through any part of the Application or Website. You further understand that Decorster Portal is not liable for accuracy, reliability, relevancy or currency any data and content provided by the third party. We advise you to use your common sense while using the data and content and its comparisons from the Website.

In no event shall Decorster Portal or its affiliates be liable for any damages (whether consequential, direct, incidental, indirect, punitive, special or otherwise) arising out of, or in any way connected with, a third party’s data, content or its comparisons made by us, regardless of whether such damages are based on contract, strict liability, tort or other theories of liability, and also regardless of whether Decorster Portal was given actual or constructive notice that damages were possible. 

Decorster Portal does not warrant that the Application or Website or any functions contained therein will be uninterrupted or error free, that defects will be corrected, or that the Application, Website or the server that makes them available are free of viruses or bugs. The Website and Applications are provided on “as is” basis and your use of the same is at your sole risk.

Decorster Portal accepts payment by Visa or Mastercard debit and credit cards in AED for its products and services. All purchases are also governed by the terms and conditions of respective merchant service providers. Please review respective merchant service provider’s user agreement and privacy policy before entering any transaction. These Terms of Use supersede all other written and oral communications or agreements with regard to the subject matters discussed in these Terms of Use. A waiver or modification of these Terms of Use will only be effective if made in writing signed by an authorized officer of Decorster Portal.

Once you place the order on the Decorster Portal, we will send you confirmation email within 24 hours.

You will not be able to cancel the order or seek any refund once the order is placed. In an unfortunate situation, where we are unable to provide the requested services, we will cancel the order and provide full refund to the amount paid to us.

Refunds will be done only through the Original Mode of Payment, refunds will be made back to the payment solution used initially by the customer. Please allow for up to 45 days for the refund transfer to be completed.

6. THIRD PARTY COMMUNICATION

You agree to communicate to any third party through the medium of chat. All the communication between you and any third party shall be solely on the website chat only not by any other means on the website. If any content, data, information, applications and materials visible in the chat between you and third party (including designers or vendors) is offensive/indecent, harmful, hateful, threatening, abusive, harassing, libelous, defamatory, obscene, vulgar, pornographic, profane, racially disparaging, indecent, invasive of another’s privacy or otherwise objectionable, you agree not to hold Decorster Portal liable for the same. You agree that the use of services and the consequences are at your own risk. Decorster Portal shall not have any liability to you for any content that may be found to be harmful, hateful, threatening, abusive, harassing, libelous, defamatory, obscene, vulgar, pornographic, profane, racially disparaging, indecent, invasive of another’s privacy or otherwise objectionable.

7. USE OF THE SERVICES

Your right to use the services is expressly conditioned in the following:

You agree that your use of services does not allow you to abuse, harass, harm or advocate or incite harassment against designers, vendors, any other person or group on the platform in any manner possible.

You shall not provide any false personal information to us or any other user, or create a false identify or impersonate another person or entity in any way.

You shall not solicit, or attempt to solicit, personal information from other users.

You shall not restrict, inhibit or discourage any person from using the service, disclose personal information about a third person on the service or obtained from the service without the consent of such person, or collect information about users.

You shall not create a new/duplicate account.

You agree not to gain unauthorized access to the Service, to other users' accounts, names or personally identifiable information, or to other computers or websites connected by any false identity account or the account which is not made by you.

You shall not gain or attempt to gain unauthorized access to the Service, to other users' accounts, names or personally identifiable information, or to other computers or websites connected or linked to the Service.

You shall not use our services and communicate anything with our designers and vendors in any manner other than the service we provide.

You shall not transfer, post or otherwise any virus, bug, spyware, worm which is technologically harmful and is intended to crash/ over burden/ disable/ impair or hijack the hardware, software, telecommunication, equipment, or any other aspect of the Service or communications equipment and computers connected to the Service or the website.

You agree that you will not post or use any content unlawful, indecent, harmful, hateful, threatening, defamatory, abusive, harassing, libelous, obscene, profane, racially disparaging, vulgar, pornographic, indecent, or invasive of another’s privacy.

As a cardholder you agree to retain a copy of transaction records and Merchant policies and rules.

The Decorster Portal Site may not be used by you for any commercial purposes such as to conduct sales of merchandise or services of any kind. You must obtain Decorster Portal’s prior written consent to make commercial offers of any kind on the Site, whether by advertising, solicitations, links, or any other form of communication. Decorster Portal will investigate and take appropriate legal action against anyone who violates this provision, including without limitation, removing the offending communication from the Site and barring such violators from use of the Site.

8. SECURITY

Your Decorster Portal account is password-protected so that only you can have access to it. You shall be solely responsible for maintaining all passwords and access codes to the Application and/or the Website, and refraining from sharing or otherwise permitting third parties to use any such passwords and/or access codes to access the Application or the Website. Decorster Portal shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

Decorster Portal staff will never proactively reach out to you and ask for any personal account information, including your password.

9. INTELLECTUAL PROPERTY

All trademarks, patents, copyrights and other intellectual property rights owned by either party on the date hereof shall continue to be owned solely by such party, and except as set forth herein, nothing in this Agreement shall be deemed to confer any rights to any such intellectual property on the other party. For purposes of clarity: (i) as between you and Decorster Portal, you shall be deemed to be the sole owner of all content entered into the Application or the Website or otherwise posted by you; and (ii) Decorster Portal is the sole owner of the name "Decorster" as well as the Website, the Application, and all source code, object code, software, content, logo, copyrights, trademarks, patents and other intellectual property related thereto or included therein. All suggestions, recommendations, bug-fixes, error-fixes or other communications from you to Decorster Portal regarding the Application or the Website shall, upon submission to Decorster Portal, be owned solely and exclusively by Decorster. You acknowledge and agree that the applicable supplier(s) of any third party software included within the Application shall own all worldwide rights, title and interest in and to such third party software (and any intellectual property rights therein), subject to such suppliers' license, if any, of such third party software to Decorster Portal. You agree that you or a third-party licensor, as appropriate, retain all copyright, patent, and trademark rights to any of Your content that you post on or through the service. You are responsible for protecting those rights.

In exchange for your use of the Website and/or the Application, you hereby grant to Decorster Portal an unlimited, perpetual, irrevocable, royalty-free, transferable, assignable, sub-licensable, worldwide license to use, reproduce, modify, publish, edit, adapt, store, host, cache, re-format, encode, translate, distribute, commercially exploit, repurpose, perform, publicly display and create derivative works of any and all content you post to the Website, submit to Decorster Portal or post through the Application, alone or as part of other works in any form, media or technology whether now known or hereafter developed, and to sublicense such rights through multiple tiers of sub-licensees, in connection with Decorster performing the services described herein. Finally, you irrevocably waive, and cause to be waived, against Decorster and its users any claims and assertions of moral rights or attribution with respect to your content. Decorster Portal shall be entitled to display advertising and/or any other content at locations of its choosing within the Website and/or Application, including without limitation adjacent to your content. 

10. CONFIDENTIALITY

You agree to treat as confidential all confidential information of Decorster Portal, not to use such confidential information for any purpose other than to the limited extent necessary to use the Application or the Website and not to disclose such confidential information to any third party except as may be reasonably required pursuant to this Agreement and subject to confidentiality obligations at least as protective as those set forth herein. Without limiting the generality of the foregoing, you shall use at least the same degree of care which you use to prevent the disclosure of your own confidential information of like importance to prevent the disclosure of confidential information disclosed by Decorster Portal, provided, however, that in no event shall such degree of care be less than reasonable in light of general industry practice.

11. LINKING

As a convenience to you and other Website visitors, the Website may contain links to websites that are owned and operated by third parties that are not affiliated with Decorster Portal. When you use these links, you will leave the Website and Decorster Portal will have no ability to protect your interests. You visit linked websites at your own risk and it is your responsibility to take any protective measures to guard against viruses and other destructive elements. Decorster Portal is not responsible for and makes no warranty or representation regarding and does not endorse any linked website or any service, product or information provided on or through the linked website.

12. DISCLAIMER OF WARRANTIES

THE DECORSTER PORTAL SERVICES ARE PROVIDED WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED 

"Released Parties" include Decorster Portal and its affiliates, employees, agents, officers, licensors and partners, and YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

DECORSTER PORTAL PROVIDES NO WARRANTY

THE SERVICE WILL MEET OR FULFILL YOUR REQUIREMENTS,

YOU WILL GET THE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE SERVICES

BY USING THE SERVICE, INCLUDING DATA YOU WILL GET ACCURATE AND RELAIBLE RESULTS

THE QUALITY OF ANY GOODS, DATA OR SERVICE AVAILABLE ON THE WEBSITE WILL MEET YOUR EXPECTATIONS AND

CORRECTION OF ANY OR ALL ERRORS IN THE SERVICES WILL BE DONE; AND

YOU ACCESS ANY OR ALL MATERIALS OBTAINED THROUGH THE USE OF THE SERVICE SOLELY AT YOUR OWN AND RISK DISCRETION, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE RESULTING FROM THE USE OF ANY SUCH MATERIAL TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA

13. LIMITATION OF LIABILITY

YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE RELEASED PARTIES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF DECORSTER PORTAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH, FROM, OR AS A RESULT OF THE SITE; (III) STATEMENTS OR CONDUCT OF ANY USER OR THIRD PARTY ON THE SERVICE; (IV) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (V) YOUR RELIANCE ON CONTENT OR DATA MADE AVAILABLE BY US; OR (VI) ANY OTHER MATTER RELATING TO THE SERVICE. THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES IS NOT ALLOWED BY SOME JURISDICTIONS. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS IN THIS PARAGRAPH MAY NOT APPLY TO YOU.

Except as explicitly set forth herein, neither Decorster Portal, its affiliates or any of any such party's equity holders, directors, officers, employees, agents, suppliers, licensors nor the like, makes any warranties of any kind, either expressed or implied, including, without limitation warranties of merchantability or fitness for a particular purpose. In addition, you hereby agree and acknowledge that:

Decorster Portal shall not be responsible for any statements or representations made or actions taken by any other party using the Application or the Website or reviewing any of your content;

Decorster Portal does not recommend or endorse any third parties hereunder, and makes no representations or warranties whatsoever regarding any such third party;

Decorster Portal is not responsible for vendors, users or any other party's compliance with applicable laws, rules or regulations

Decorster Portal's services are administrative in nature and Decorster Portal is not responsible for ensuring that any third party honor any offer, coupon, rebate, discount or other obligations such third party may have towards you;

Decorster Portal shall not, under any set of circumstances, be responsible or liable for any content, including any content which may violate applicable law and/or a third party's intellectual property rights;

The Application and/or Website may not function properly or as intended at times; and

Decorster Portal shall not be liable in any way for any delay in responding to an inquiry or question forwarded by you or the effects any delay or unavailability may have on you.

Decorster Portal shall not be liable in any way for failure to deliver a particular design package or packages as per the given schedule by the designer.

Decorster Portal shall not be liable for dispute regarding in installation, execution service and any other issue in custom packages selected by you as all the installation services are provided by the third-party contractor.

You agree that Decorster Portal shall not be liable for any damages arising from any such interruption, suspension or termination of the website and/or application.

Decorster Portal shall not, under any set of circumstances, be liable to you for any special, incidental, indirect, punitive or consequential damages, including, but not limited to, lost profits or data, arising out of this agreement or your use of the application or website, whether based in contract, tort or any other legal theory, even if advised of the possibility of such damages. In any event, Decorster Portal's total liability to you for any claim arising hereunder or related hereto shall not exceed AED100/-.

14. THIRD PARTY DISPUTE

If you have any dispute with any third party, any service provider, any third party service and between client and designer is directly between you and such third party, you irrevocable release the Decorster Portal from any such and all claims, disputes, damages and the demands of any/every kind arising out of such disputes in any manner. You agree to resolve all the disputes of any or all kind with designer releasing Decorster Portal of all claims, disputes, damages and demands.

15. FORCE MAJEURE

Decorster Portal shall not be liable to you for failure or delay in performing any obligations hereunder if such failure or delay is due to circumstances beyond its reasonable control. 

16. TERM AND TERMINATION

This Agreement shall continue in full force until Decorster Portal electing to terminate your access to the Application or the Website, with or without reason or notice. For purposes of clarity, you are entitled to terminate your Decorster Portal account at any time. Decorster Portal reserves the right to modify, suspend, or discontinue the services or access to the Applications or Website without any notice at any time and without any liability to you.

Decorster Portal shall not be responsible for the return of any content of any kind to you upon any termination of this Agreement or suspension of your access to the Application or the Website, including without limitation any information input into the Application by you.

All provisions which by their nature should survive to give effect to those provisions shall survive the termination of this Agreement. 

17. INDEMNITY

You agree to defend, indemnify and hold harmless Decorster Portal and its officers, directors, employees, agents and affiliates (each, an Indemnified Party), from and against any losses, claims, actions, costs, damages, penalties, fines and expenses, including without limitation attorneys' fees and expenses, that may be incurred by an Indemnified Party arising out of, relating to or resulting from your unauthorized use of the Website and/or Applications or from any breach by you of this Agreement, including without limitation any actual or alleged violation of any federal, state or local statute, ordinance, administrative order, rule or regulation.

18. COPYRIGHT POLICY

This Agreement shall continue in full force until Decorster Portal electing to terminate your access to the Application or the Website, with or without reason or notice. For purposes of clarity, you are entitled to terminate your Decorster Portal account at any time. Decorster Portal reserves the right to modify, suspend, or discontinue the services or access to the Applications or Website without any notice at any time and without any liability to you.

A physical or electronic signature of a person authorized to act on behalf of the owner of the works that have been allegedly infringed;

Identification of the copyrighted work alleged to have been infringed (or if multiple copyrighted works located on the Service are covered by a single notification, a representative list of such works);

Identification of the specific material alleged to be infringing or the subject of infringing activity, and information reasonably sufficient to allow Decorster Portal to locate the material on the Service;

Your name, address, telephone number, and email address (if available);

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

19. FEEDBACK

1. We appreciate hearing from our users and welcome your comments regarding the service Please be advised, however, that if you send us creative ideas, suggestions, inventions, or materials ("Creative Ideas"), we will:

own, exclusively, all now known or later discovered rights to the Creative Ideas;

not be subject to any obligation of confidentiality and will not be liable for any use or disclosure of any Creative Ideas; and

be entitled to unrestricted use of the Creative Ideas for any purpose whatsoever, commercial or otherwise, without compensation to you or any other person.

You agree that Decorster Portal don’t commit to post the Feedback / review received from you on our website in any manner.

20. MISCELLANEOUS

The rights and obligations of the parties under this Agreement shall be governed by the laws of United Arab Emirates, without reference to conflict of law principles, and all disputes arising hereunder or in connection with this Agreement, the Website and/or the Application shall be resolved by the Dubai Courts. You hereby consent to exclusive jurisdiction of Dubai Courts United Arab Emirates. If any provision of this Agreement is held to be unenforceable or invalid for any reason, or if any governmental agency rules that any portion of this Agreement is illegal or contrary to public policy, the remaining provisions, to the extent feasible, will continue in full force and effect with such unenforceable or invalid provision to be changed and interpreted to best accomplish its original intent and objectives. Decorster Portal makes no representation that this Site is appropriate for use in other locations. If you use this Site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this Site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

21. CHANGES TO THE TERMS

Decorster Portal Panel reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement, effective with or without prior notice. Your continued use of the Website or Application following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such changes.
